Precious by Kerry and/or their affiliates provide website features and other products and Services \ Products to you when you visit or shop at Precious by Kerry (the “website”), use Precious by Kerry or Services \ Products Precious by Kerry provides Services \ Products and sells products to you subject to the conditions set out on this page.

Please read these conditions carefully before placing an order. By placing an order with us you signify your agreement to be bound by these conditions. 

General

Any contract between us, whether for use of the site or in relation to the purchase of products or services through the site will be governed by the laws of the UK and all parties submit to the non-exclusive jurisdiction of the British Courts.

We have taken every care in the preparation of the content of this website, however we cannot guarantee uninterrupted and totally reliable access to this website, and so therefore cannot guarantee that the information will always be completely up to date and free of mistakes. To the extent permitted by applicable law, Precious by Kerry disclaims all warranties; express or implied, as to the accuracy of the information contained in any of the materials on this website and will accept no liability for any loss or damage arising as a result of problems with access. 

Contract

When you place an order to purchase a product from Precious by Kerry we will send you a message confirming receipt of your order and containing the details of your order (the “Order Confirmation”). 

The Order Confirmation is acknowledgement that we have received your order, and does not confirm acceptance of your offer to buy the product(s) or the Services \ Products ordered. We only accept your offer, and conclude the contract of sale for a product ordered by you, when we dispatch the product to you and send e-mail confirming to you that we’ve dispatched the product to you  

Copyright, Authors’ and Database Rights

All content included in or made available through any Precious by Kerry Services \ Products, such as text, graphics, logos, button icons, images, audio clips, digital downloads and data compilations is the property of or its content suppliers and is protected by UK and international copyright, authors’ rights and database right laws. The compilation of all content included in or made available through any Precious by Kerry Services \ Products is the exclusive property of Precious by Kerry and is protected by UK and international copyright and database right laws.

Licence and Access

Subject to your compliance with these Conditions of Use \ Sale and applicable Services \ Products Terms and your payment of any applicable fees, Precious by Kerry or its content providers grant you a limited, non-exclusive, non-transferable, non-sub licensable licence to access and make personal and non-commercial use of the Precious by Kerry Services \ Products. This licence does not include any resale or commercial use of any Precious by Kerry. Services \ Products or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of any Precious by Kerry Services \ Products or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools.

All rights not expressly granted to you in these terms and Conditions \ Sale or any Services \ Products Terms are reserved and retained by Precious by Kerry or its licensors, suppliers, publishers, rights holders, or other content providers. No Precious by Kerry Services \ Products, nor any part of any Precious by Kerry Services \ Products, may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without our express written consent.   

Right of Cancellation 

You have the right to cancel your request within 14 days of placing your order. Please notify us in writing at plummerkerry@yahoo.co.uk with your request to cancel.

Customs

Any additional charges for customs clearance must be borne by you; we have no control over these charges. 

Customs policies vary widely from country to country, so you should contact your local customs office for further information. Additionally, please note that when ordering from us, you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the products. Your privacy is important to us and we would like our international customers to be aware that cross-border deliveries are subject to opening and inspection by customs authorities.

 Our Liability

We will do our utmost to ensure that availability of the Precious by Kerry Services \ Products will be uninterrupted and that transmissions will be error-free. However, due to the nature of the internet, this cannot be guaranteed. Also, your access to Precious by Kerry Services \ Products may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or Services \ Products. We will attempt to limit the frequency and duration of any such suspension or restriction.

Precious by Kerry and its affiliates will not be responsible for (i) losses that were not caused by any breach on our part, or (ii) any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure), or (iii) any indirect or consequential losses that were not foreseeable to both you and us when the contract for the sale of products by us to you was formed.

The laws of some countries do not allow some or all of the limitations described above. If these laws apply to you, some or all of the above limitations may not apply to you and you might have additional rights.

Nothing in these conditions limits or excludes our responsibility for fraudulent representations made by us or for death or personal injury caused by our negligence or wilful misconduct.

We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your right to have the products sent to you within a reasonable time. If the delay occurs before the products are dispatched, we will not charge you for the products until they are dispatched and you may cancel your order at any time prior to dispatch.

You accept that we have an interest in limiting the personal liability of our officers and employees and, having regard to that interest, you acknowledge that we are a limited liability entity; you agree that you will not bring any claim personally against our officers or employees in respect of any losses you suffer in connection with the website or these terms and conditions (this will not, of course, limit or exclude the liability of the limited liability entity itself for the acts and omissions of our officers and employees) Alterations to Services \ Products or Amendments to the Conditions of Use

We reserve the right to make changes to our Services \ Products, policies, terms and conditions including these Conditions of Use \ Sale, and Services \ Products Terms at any time. You will be subject to the terms and conditions, policies and Conditions of Use \ Sale in force at the time that you use the Precious by Kerry Services \ Products. If any of these Conditions of Use \ Sale is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

Amendments to The Conditions of Sale 

We reserve the right to make changes to our website, policies, and terms and conditions, including these Conditions of Sale at any time. You will be subject to the terms and conditions, policies and Conditions of Sale in force at the time that you order products from us, unless any change to those terms and conditions, policies or these Conditions of Sale is required to be made by law or government authority (in which case it may apply to orders previously placed by you). If any of these Conditions of Sale is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

Applicable Law

These conditions and the interpretation of its terms shall be governed by and construed in accordance with the laws of the United Kingdom. 

Breach

If you breach these Conditions of Use \ Sale and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these Conditions of Sale.

Minors

We do not sell products for purchase by children. If you are under 18 you may use our Services \ Products only with the involvement of a parent or guardian.

Casting in Resin

Breastmilk

We have developed our breastmilk preservation technique over the past 4 years and now use many different preparation and preservation processes together, ensuring that your breastmilk is safe in our hands and guaranteed not to discolour. I have 4 year old preserved milk that is still the same as the day it was prepared. We only ask for 12ml of breastmilk and there will be some left over which we will store for 1 year (although I have never thrown any out yet) we can get by with less if necessary, although IF THIS IS YOUR LAST MILK PLEASE ONLY SEND HALF AND FREEZE HALF. As you will see from your collection pack, everything is clearly labelled and remains so until your piece makes its way safely to you. There is no way that components could ever be mixed up within my system.

Ashes

When you send us your loved ones’ ashes they will be treated with the upmost respect and care, as with any components we receive. We only need a teaspoon full and will return any that we do not use…as you will see from your collection pack, everything is clearly labelled and remains so until your piece makes its way safely to you. There is no way that components could ever be mixed up within my system.

Hair

We need a small pinch of hair, about 20 strands. The length doesn’t matter as we can sculpt it end to end in the resin. Better to send more than less as any that is not used can be sent back with your order.

Umbilical Cord

We only shave of tiny flecks of the cord.  I like to add a variety of colours from it however feel free to send a tiny amount.

Placenta

If you have already received your encapsulated placenta, please send one capsule.

Crushed first Tooth

We will only need a tiny amount of this and any unused material will be sent back with your order.

The Resin

The Polycraft resin that we use is a top of the range lead free, crystal clear, hard casting resin which has been extensively tested for UV stability. I have worked with the manufacturers to gain total confidence in this product. They have shown a proven track record of pieces withstanding 2 years in Strong UV light with little to no colour change. However, that said, it is a form of plastic and over time and extensive exposure to sunlight, all plastics will yellow over time.

I am constantly refining and improving my service as 100% customer satisfaction is imperative and am confident in my processes and procedures. Should you find any undue discolouration in any of your pieces within the first 30 days, please contact us immediately and we will replace them.

Infusing in Glass

We can infuse breastmilk, placenta, cord, crushed first tooth and loved ones ashes into Glass but hair unfortunately burns off. You would think that the milk would do the same but its just pure alchemical magic! Glass creations using rods are melted in a flame temperature reaching up to 2,760 °C (5,000°F).  After the creation is complete, it will undergo another 12 hour kiln annealing cycle to ensure durability.

About your Glass Jewellery

Suitable for everyday wear.

Glass is annealed to make the internal integrity as strong as possible, but heavy knocks may chip the glass.

Your creation is UV proof

Your breastmilk will NEVER discolour, change appearance or alter in any way, making it the durable and long lasting.

The breastmilk is preserved and infused in the glass.

It should be treated like fine jewellery and the findings could get damaged causing you to lose your glass inclusion.

 

925 Sterling silver

Silver is a precious metal and, much like gold, is too fine to be utilised in its pure form.  Sterling silver items contain a minimum of 92.5% pure silver. To make silver durable enough for use in jewellery, pure silver, which has a .999 fineness (99.9%), is often alloyed with small quantities of copper (7.5%). The copper is added to strengthen the silver and the resulting product is .925 sterling silver (92.5%). Sterling silver tarnishes over time.  Tarnish is a dulling which naturally occurs when silver reacts with sulphur or hydrogen sulphide in the air. Most people think silver tarnishes due to oxidation. But, chemically speaking, silver is not very reactive—it does not react with oxygen or water at normal temperatures. Perfume, sweat and other chemicals may cause sterling silver to tarnish quicker.  Gentle polishing with a soft cotton cloth can remove tarnish as soon as it starts to show.

Fine silver

Fine silver is 99.9 % pure silver and is used to cast ashes or imprint fingerprints and miniaturised hands/ feet jewellery.  Its nature makes it much softer than 925 silver and therefore proper care needs to be taken to ensure longevity of your purchase.

Avoid submerging jewellery pieces in water and that includes showering, mineral spas, bathing, swimming and other activities.  Your pieces will look newer longer if you take them off before swimming, showers, etc.

Avoid harsh chemicals/cleaning solutions, such as perfume, hairspray, nail varnish remover, body lotions, household cleaners, dishwashing liquid, hand soaps. etc. Apply / use these products before wearing your creation.  Chemicals will also speed up the tarnishing process of sterling silver creations.

Remove your creation before exercising or before bedtime.  Sleeping with your creation will damage it.

Avoid knocks, scratches, bending it, standing on it, sleeping in it or any other excessive force.

Please ensure that you regularly check that the findings are securely fastened and that there are no broken or lose pieces. We cannot be held responsible if your creation becomes detached or lost.

I create my pieces to be worn every day, but should you want to store them, make sure that it is clean and dry before storage as moisture will speed up the tarnishing process.  If storing in a box add a few rice grains to keep the box dry and reduce the risk of tarnishing. Clean sterling silver creations with your silver cleaning cloth to remove tarnish and restore its brightness.

9ct Yellow Gold

9ct gold is 37.5% pure gold, with other metals making up the other 62.5%. People often prefer to have a higher percentage of gold than this, as it makes the metal more precious, but 9ct is favoured by some as the high proportion of other metals makes it more hard-wearing. If you want a more long-lasting ring, and don’t mind it being less ‘pure’, then 9ct is the choice for you.

Over time, the ring may dull from contact with detergents, moisturisers and other chemicals – ideally you would take the ring off as needed to protect it from such substances. If it does dull then even a quick buff with a soft cloth should brighten it up. Gold will show scratches from every day wear and tear; the first few will be the most obvious but over time it will develop a more pleasing patina.

Yellow gold properties and usage

Gold in its pure form is too soft to be worn as jewellery, as it would not withstand the everyday stresses that jewellery is exposed to. Instead it is mixed with other metals such as e.g. copper, zinc, silver or cobalt, to make a stronger alloy. A pleasant consequence of alloying gold with other metals is that it the end result is often a different colour – so white and rose golds are now cherished in their own right. 9ct White Gold

Maintaining white gold rings is a bit trickier compared with caring for rings made of yellow gold or platinum. The reason has to do with how white gold is made: It consists of yellow gold mixed with white metals and covered with plating (usually rhodium) to hide the yellowish colour of the resulting alloy. You may feel the want/need to have your ring re-coated and with a resin setting this may be trickier, so we can now offer this service for £30.

Payment

Payment for your order is made up front.

 Details of where to send payments can be found during the checkout process.

Unpaid order will be rejected after 24 hours. You are invited to resubmit your order at a more suitable time. 

Changes to your order

We are able to accept any changes to your order until such time as we receive your inclusions. After you are informed that we received your inclusions, it will be accepted that your order is correct and we will proceed as such.

Collection Pack and Shipping Service

We offer a Collection Pack and Worldwide Shipping service for the flat rate of £8.00. Your collection pack will be sent to you including a ring sizer, if required, including an addressed return pack containing return containers for your respective components. Clients within the UK will have a return stamp and any of our international clients will need to attach your equivalent of a first class large letter stamp. Then just pop it back in the post to us.

Please ensure that your postage address is correct on your order and that it matches your ordering address as we will be mailing your creation to this address.  All orders received online are considered correct and it is your responsibility to ensure that the information is correct.

Caring for your creation

Guidance and advice on caring for your jewellery and mementos are found in the FAQ. Failure may result in your creation being damaged over time and / or fittings becoming detached.  Repairs can be undertaken through prior arrangement with us.  

Refunds and returns

All faults / damages must be reported within 7 days of receipt of your creation. If we receive no communication within 7 days then the jewellery is deemed to be in full working order with no problems. 

Each creation is handmade and although we will endeavour to replicate your purchase to the sample you chose, there will be slight differences in appearance. Please also note that the resin tinting of your creation may not always be exactly as it appears online.  Each resin piece is hand crafted and possible air bubbles may be evident.  

As each creation is your personal breast milk or any other inclusion, we are unable to accept any refunds or offer any returns. 

Precious by Kerry is not responsible for any losses or damages to your creation, irrespective of the age of it. Guidance on Caring for your creation is provided and as such, we cannot be held responsible for how you wear or use your creation.  This includes necklace chains that break, jump rings that open and plating that wears off.

If the Item is damaged you can return the item to us at the cheapest possible postage fee up to £ 5.00.  Please retain proof of postage.

The client is responsible for presenting their correct ring size, either using our ring sizer in your pack or from a reputable jeweller. If a true size has been presented but you feel you require a different size, this can be rectified at a cost of £10. The return postal cost will be at the clients’ expense.

Warrantees

We offer 6 months warrantee on our items.

This guarantee does not extend to damage caused by obvious misuse where our aftercare instructions are not followed or if the jewellery is lost or stolen.  

The guarantee does not cover jump rings that have opened or necklaces that have snapped.  Proper care needs to be taken to ensure that the jewellery is looked after.

Please note that we reserve the right to arrange an independent inspection of the goods. If they are found on inspection to not be faulty or as the result of fair wear and tear, negligence or wilful damage then we reserve the right to charge for the inspection. The Buyer and Precious by Kerry both agree to be bound by the result of the independent valuation. 

If you wish to return the item please send by recorded or special delivery and let us know when it is on its way. If it breaks after 6 months we will repair it for a nominal cost. 

Our total liability to the performance of this contract shall be limited to the value of the goods. We shall not be liable for any direct, indirect of consequential compensation arising out of the performance or non-performance of this contract. 

Conditions on claiming a Prize

  1.  The giveaway will clearly define what is offered and what inclusions are included in the creation.  
  2.  Unless stated to the contrary, the giveaway cannot be changed, swapped for another creation or redeemed for cash.
  3.  Customisation options will be clearly defined in the giveaway conditions.
  4.  Delivery charges will be paid by the winner.
  5.  The winning entrant 3 working days to claim their giveaway.  Inclusions must be received for processing within one calendar month. 
  6. Failure to receive the inclusions in the specified time will result in the giveaway being forfeit.  Any payments made at the time will be refunded excluding any transaction charges that may be applicable.
  7.  Mailing of the inclusion is at the expense of the winning entrant. 

Safety

Please note, all our creations are not safe for consumption and may present a choking hazard.  Please inspect your creation regularly for wear and tear and ensure it is not left unattended with children or animals. Unless specified to the contrary for glass creations, all our creations are made using resin.  When you receive your completed creation, the resin is cured and in a hardened form.  The hardened, finished resins are almost non-toxic; it is exposure to the uncured resin components in its liquid form that can be harmful. In a two-component epoxy product like we use, the epoxy resin and the curing agent are packaged separately and it is mixed together just before being used. Each component can be hazardous. The resins, can affect our skin, respiratory tract, eyes and even your internal organs.  As a professional artist, we take all the proper safety procedures in our workspace when working with your inclusions and with these highly toxic chemicals.  This includes the use of full respirator masks, protective eye ware, nitrile gloves and protective clothing when handing resin in its raw liquid form.

Returns Policy

 

RETURNS

Our policy lasts 30 days. If 30 days have gone by since your purchase, unfortunately we can’t offer you a refund or exchange.

To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.

All of our bespoke items are exempt from being returned. The only items eligible for return are accessories, such as bracelets and necklaces. Anything custom made with your inclusions is non returnable unless faulty.

Gift cards are non-returnable and have an expiry date of 6 months from date of issue.

To complete your return, we require a receipt or proof of purchase. Please return this along with your item to

REFUNDS

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.

If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within 10 working days.

EXCHANGES

If for any reason you are unhappy with your piece, please contact us at the earliest opportunity at contact@preciousbykerry.com

If your item is faulty, or not as ordered, we will remake your item free of charge. In the case of a minor error (e.g. decoration missing) you may choose to accept a partial refund. In most cases, we will need to receive the original piece back in order to inspect it thoroughly. Once we have received the item back, we will contact you to discuss the options available to you. 

We offer exchanges on faulty items for six months from the date of delivery. It is your responsibility to look after your jewellery in accordance with our instructions provided with your order. You can see these here. If we suspect your jewellery has not been cared for correctly, we reserve the right to refuse an exchange. As we make our jewellery with resin, there is an expected amount of natural discolouration over time. We expect this to be a very slow process over a number of years. If you have any sudden or extreme discolouration of your piece, please contact us.

 

CHANGES TO YOUR ORDER

If your inclusions have not yet been posted to us, you can make minor changes to your order, including colour changes, swapping decorations of the same value or changing your ring size.

If you need to make major changes to your order, such as changing your jewellery type, ring band, bezel size, add any extra decorations or any other change that involves a price change, you will need to cancel and reorder using the correct options. Please ensure you label your inclusions with the correct order number when sending them in.

If your inclusions have arrived and been logged, unfortunately we cannot make any changes to your order.

 

CANCELLATION

Once your inclusions have been received, we can begin the process of making your piece at any time. There are many steps involved including the preservation of inclusions, preparation of decorative backgrounds etc, and these are sometimes done in advance. We will often batch process milk weeks before we are due to make your piece. For this reason, we cannot cancel your order once your inclusions have been received.
